This Webinar will be presented in the form of a Panel Discussion, focusing on the latest Constitutional Court judgment in the matters of Salungano Group Ltd v Mashwayi Projects (Pty) Ltd and Others and Ndalamo Coal (Pty) Ltd v Mashwayi Projects (Pty) Ltd and Others.
The Constitutional Court reversed the Supreme Court of Appeal’s judgment concerning whether a post-commencement finance creditor has a voting interest within the framework of Chapter 6 of the Companies Act No. 71 of 2008.
The Constitutional Court concluded that no voting interest attaches to a post-commencement finance claim.
This Panel Discussion will provide an opportunity to explore the implications of this judgment and its relevance to practitioners involved in business rescue, restructuring and post-commencement finance.
